- It honestly doesn't even matter then because both slander and libel are nearly impossible to prove in court and the law traditionally always favors free speech. It doesn't have to be true either it can merely be an OPINION. Opinion basically trumps slander/libel in pretty well every case there is. It can even be flipped around too, like with Larry Flint's case, where basically they got the other side to openly say that the opinions/accusations were 'totally unbelievable'...as such, even if untrue, well if they can't be believed it doesn't even ~matter~ if they're libel/slander since effectively no damage can be done unless they can be ~perceived~ as real truth.
